STATE OF NEW HAMPSHIRE

In the Year of Our Lord Two Thousand Twenty-Six

AN ACT identifying certain school district offices as incompatible for purposes of school district elections.

Be it Enacted by the Senate and House of Representatives in General Court convened:

 1 Qualifications for Office; School District Elections RSA 671:18 is repealed and reenacted to read as follows: 

 671:18 Qualifications. 

 I. ?To become a candidate for any school district office, a person must be a registered voter in the district. ?No person shall simultaneously hold more than one of the following offices: member of school board,?school district moderator,?school district treasurer,?school district auditor,?school district clerk,?or budget committee member-at-large under RSA 32:15 covering the school district, or advisory budget or finance committee member under RSA 32:24 covering the school district.? No person employed on a salaried basis by a school administrative unit or by any school district within a school administrative unit shall be a school board member or budget committee member-at-large under RSA 32:15. ?Salaried positions shall include, but are not limited to, the following: ?teacher, custodian, administrator, secretary, school bus driver (if paid by the district), school lunch worker and teacher's aide. 

 II. ?No person shall at the same time file a declaration of candidacy for any 2 or more elected offices that are incompatible under paragraph I. 

 2 Effective Date. This act shall take effect 60 days after its passage.
