ANACT
To amendchapter273,RSMo,by addingtheretoone newsectionrelatingto inducingthe
deathof dogsand cats,witha penaltyprovision.
Be it enactedby the GeneralAssemblyof the state of Missouri,as follows:
SectionA. Chapter273,RSMo,is amendedby addingtheretoone new section,to be
2  knownas section273.361,to readas follows:
273.361.1. Exceptas providedin subsection2 of thissection,thesolemethodof
2inducingthedeathof a dogor a catin an animalcontrolagency, animalshelter, or
3pound,as suchtermsaredefinedin section273.325,shallbe theinjectionof sodium
4pentobarbitalor a derivativethereof.Theuseof anyothermethodto inducethedeath
5of a dogor a cat including,butnotlimitedto, theuseof nonanestheticinhalantssuchas
6carbonmonoxideor carbondioxidegas,a decompressionchamber, electrocution,
7gunshot,bluntforce trauma,or injectionof a neuromuscularblockingagent,shallbe an
8offenseas providedin section273.347.
92.  Notwithstandinganyprovisionof subsection1 of thissectionto thecontrary,
10anysubstancethatis clinicallyprovento be as humaneas sodiumpentobarbitaland
11thathasbeenofficiallyrecognizedas  suchbytheAmericanVeterinaryMedical
12Associationmaybe usedin lieuof sodiumpentobarbitalto inducethedeathof a dogor
13a catif thedirectorhasdeterminedthatthere is a shortageof sodiumpentobarbital.
14Anysuchdeterminationmadeby thedirectorshallbe validfora one-yearperiod
15beginningon thedatesuchdeterminationwasmade.
163.  Neithera chamberthatusescommerciallybottledcarbonmonoxidegasor
17otherlethalgasnora chamberthatcausesa changein bodyoxygenby meansof altering
EXPLANATION—Matterenclosedin bold-facedbrackets[thus]in the abovebill is not enactedand is
intendedto be omittedfromthe law. Matterinbold-facetypein the abovebill is proposedlanguage.
