An act relating to the City of Lake Wales, Polk 2
County; providing an exception to general law for 3
licensed alcoholic beverage vendors located within a 4
specified area of the City of Lake Wales; providing 5
that licensed alcoholic beverage vendors within the 6
specified area must comply with all ordinances, 7
statutes, and rules not inconsistent with specified 8
provisions; defining the specified area of the city to 9
which such exception applies; providing an effective 10
date. 11

Be It Enacted by the Legislature of the State of Florida: 13

Section 1. Notwithstanding any other provision of the 15
Beverage Law as defined in s. 561.01(6), Florida Statutes, the 16
holder of any alcoholic beverage vendor license that permits 17
sales of alcoholic beverages for consumption on the premises, 18
and for which the designated premises of such license are 19
located on any property within the Lake Wales Arts, Culture and 20
Entertainment District of the City of Lake Wales, shall be 21
authorized to allow patrons to remove any alcoholic beverage in 22
an open container from the licensed vendor premises for purposes 23
of consumption away from the licensed vendor premises within the 24
district. Such licensed alcoholic beverage vendors located 25

within the district shall be authorized to allow patrons to 26
remove alcoholic beverages from the licensed vendor premises 27
regardless of the class, type, or series of license held and 28
without the need for additional licensure or approval by the 29
Division of Alcoholic Beverages and Tobacco. 30
Section 2. The holder of any alcoholic beverage vendor 31
license located within the Lake Wales Arts, Culture and 32
Entertainment District shall comply with all other local 33
ordinances, state alcoholic beverage laws, and rules of the 34
division not inconsistent herewith. 35
Section 3. For the purposes of this act, the Lake Wales 36
Arts, Culture and Entertainment District means the area of land 37
situated in Section 2, Township 30 South, Range 27 East, City of 38
Lake Wales, Polk County, more particularly described as follows: 39

BEGIN at the southeast corner of Lot 1, Block 1 of 41
Heckscher Second Subdivision, according to the plat 42
thereof as recorded in Plat Book 6, Page 45, public 43
records of Polk County, Florida; thence Westerly along 44
the south line of Lots 1 through 20, Block 1 of said 45
Heckscher Second subdivision to the east right-of-way 46
line of Wetmore Street S; thence Northerly along said 47
east right-of-way line to the south right-of-way line 48
of Sessoms Avenue W; thence Easterly along said south 49
right-of-way line to the west right-of-way line of 1st 50
