56-211A.PHOTOGRAPHICVERIFICATIONFORFEDERALFOODSTAMPPRO-11
GRAM.(1)NolaterthanJanuary1,2026,thedepartmentofhealthandwelfare12
shall:13
(a)Addphotographicidentificationtoallnewelectronicbenefit14
transfercardsissuedtorecipients.Suchphotographicidentification15
electronicbenefittransfercardsshallbeinaformapprovedbythede-16
partmentofhealthandwelfareandmaynotpreventanyauthorizedusers17
inthehouseholdfromaccessingbenefits;18
(b)Developastrategytoreplaceallelectronicbenefittransfercards19
withoutphotographsincirculationwithineighteen(18)monthsfor20
householdsthatcontinuetoparticipateintheprogram;and21
(c)CoordinatewiththeIdahotransportationdepartmentand,tothe22
extentpermissibleunderfederalandstatelaw,minimizecostsof23
implementationbyusinganindividual'sphotographordigitalimage24
maintainedbytheIdahotransportationdepartmentforpurposesofthis25
section.26
(2)Therequirementsofsubsection(1)ofthissectionshallnotapply,27
withouttheconsentoftheauthorizedusers,toanelectronicbenefittrans-28
fercardissuedforahouseholdthat:29
(a)Doesnotincludeanyadultmembers;30
(b)Inwhichalloftheadultmembersofthehouseholdaresixty(60)31
yearsofageorolder;32
(c)Inwhichalloftheadultmembersofthehouseholdareblind,dis-33
abled,oravictimofdomesticviolence;or34
(d)Inwhichalloftheadultmembersofthehouseholdhavereligious35
objectionstobeingphotographed.36
(3)If,withintwelve(12)monthsofahouseholdrequestingareplace-37
mentelectronicbenefittransfercard,anymemberofthehouseholdrequests38
two(2)additionalreplacementcards,thedepartmentshallreferthehouse-39
holdforinvestigation.40

SECTION2.Anemergencyexistingtherefor,whichemergencyishereby1
declaredtoexist,thisactshallbeinfullforceandeffectonandafter2
July1,2025.3
