1 AN ACT concerning State government.

2 Be it enacted by the People of the State of Illinois, 

3represented in the General Assembly:

4 Section 5. The Nuclear Safety Law of 2004 is amended by 

5adding Section 95 as follows:

6 (20 ILCS 3310/95 new)

7 Sec. 95. Right of entry.

8 (a) As used in this Section, "disaster" and "incident" 

9have the meanings given to those terms in Section 4 of the 

10Illinois Emergency Management Agency Act.

11 (b) IEMA-OHS has the right to enter on public and private 

12property in order to take environmental samples in response to 

13a disaster or incident that causes, or threatens to cause, 

14radioactive contamination consistent with the regulatory 

15requirements of the U.S. Nuclear Regulatory Commission.

16 Section 99. Effective date. This Act takes effect upon 

17becoming law.
