RELATING TO PROPERTY -- ESTATES IN REAL PROPERTY--LIMITATION OF 
RESTRICTIVE COVENANTS

It is enacted by the General Assembly as follows: 
SECTION 1.  Section  34-4-21  of  the General  Laws  in  Chapter  34-4  entitled  "Estates  in 1 
Real Property" is hereby amended to read as follows: 2 
34-4-21. Limitation of restrictive covenants. 3 
If a covenant or restriction concerning the use of land, other than housing restrictions as 4 
set forth in § 34-39.1-3, and conservation restrictions and preservation restrictions as set forth in 5 
§§  34-39-3  and  34-39-4,  is  created  by  any  instrument  taking  effect  after  May  11,  1953, the 6 
covenant  or  restriction, if unlimited  in  time  in  the  instrument creating  it,  shall cease  to  be  valid 7 
and  operative  thirty  (30)  years  after  the  execution  of the said instrument creating  it;  provided, 8 
however, that the terms of this section shall not apply to any covenants and/or restrictions initially 9 
created  by  the  Commerce  Oil Refining  Corporation  with  respect  to  land  in  the  town  of 10 
Jamestown. 11 
SECTION 2. This act shall take effect upon passage. 12
