A BILL
To amend title 13, United States Code, to provide that
individuals in prison shall, for the purposes of a decen-
nial census, be attributed to the last place of residence
before incarceration, and for other purposes.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Correct the Census 4
Count Act’’. 5

SEC. 2. RESIDENCE OF INCARCERATED INDIVIDUALS. 1
Section 141 of title 13, United States Code, is 2
amended— 3
(1) by redesignating subsection (g) as sub-4
section (h); and 5
(2) by inserting after subsection (f) the fol-6
lowing: 7
‘‘(g)(1) Effective beginning with the 2030 decennial 8
census of population, in taking any tabulation of total pop-9
ulation by States under subsection (a) or (c), the Sec-10
retary shall, with respect to an individual incarcerated in 11
a State or Federal correctional center as of the date on 12
which such census is taken, attribute such individual to 13
such individual’s last place of residence before incarcer-14
ation. 15
‘‘(2) In carrying out this subsection, the Secretary 16
shall consult with each State department of corrections 17
and the Bureau of Prisons to collect the information nec-18
essary to make the determination required under para-19
graph (1).’’. 20
