PUBLIC FINANCE. 17

BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF ARKANSAS: 19

SECTION 1. Arkansas Code § 19-4-803(c), concerning exemptions from the 21
laws concerning the expenditure of cash funds, is amended to read as follows 22
to repeal obsolete language and make stylistic changes: 23
(c) The Arkansas Comprehensive Health Insurance Pool, created under 24
the Comprehensive Health Insurance Pool Act, § 23-79-501 et seq., and its 25
board of directors, and the Arkansas Property and Casualty Insurance Guaranty 26
Fund and its advisory association, referenced under the Arkansas Property and 27
Casualty Insurance Guaranty Act, § 23-90-101 et seq., and the Arkansas Life 28
and Health Insurance Guaranty Association and its board of directors, 29
referenced under the Arkansas Life and Health Insurance Guaranty Association 30
Act, § 23-96-101 et seq., are hereby exempt from the provisions of this 31
subchapter. 32

SECTION 2. Arkansas Code § 19-5-922(b)(2), concerning the State 34
Insurance Department Trust Fund, is amended to read as follows to repeal 35
obsolete language: 36

(2) The fund shall be used: 1
(A) To defray the expenses of the State Insurance 2
Department in the discharge of its administrative and regulatory powers and 3
duties as prescribed by law and as set out in the State Insurance Department 4
Trust Fund Act, § 23-61-701 et seq.; and 5
(B) To defray the administrative expenses and losses 6
incurred by the Arkansas Comprehensive Health Insurance Pool of the 7
Comprehensive Health Insurance Pool Act, § 23-79-501 et seq., or its 8
successor; and 9
(C) To fund capital expenditures and training for fire 10
departments certified by the Division of Emergency Management. 11

SECTION 3. DO NOT CODIFY. CONSTRUCTION AND LEGISLATIVE INTENT. 13
It is the intent of the General Assembly that: 14
(1) The enactment and adoption of this act shall not expressly 15
or impliedly repeal an act passed during the regular session of the Ninety-16
Fifth General Assembly; 17
(2) To the extent that a conflict exists between an act of the 18
regular session of the Ninety-Fifth General Assembly and this act: 19
(A) The act of the regular session of the Ninety-Fifth 20
General Assembly shall be treated as a subsequent act passed by the General 21
Assembly for the purposes of: 22
(i) Giving the act of the regular session of the 23
Ninety-Fifth General Assembly its full force and effect; and 24
(ii) Amending or repealing the appropriate parts of 25
the Arkansas Code of 1987; and 26
(B) Section 1-2-107 shall not apply; and 27
(3) This act shall make only technical, not substantive, changes 28
to the Arkansas Code of 1987. 29
