To direct the Secretary of the Army to provide an annual briefing regarding
the accountability of an Army commander to ensure the welfare of
personnel under the jurisdiction of such commander.

A BILL
To direct the Secretary of the Army to provide an annual
briefing regarding the accountability of an Army com-
mander to ensure the welfare of personnel under the
jurisdiction of such commander.
Be it enacted by the Senate and House of Representa-1
tives of the United States of America in Congress assembled, 2
SECTION 1. SHORT TITLE. 3
This Act may be cited as the ‘‘Smitty Check Act of 4
2024’’. 5

SEC. 2. ANNUAL BRIEFING ON THE ACCOUNTABILITY OF 1
ARMY COMMANDERS TO ENSURE THE WEL-2
FARE OF PERSONNEL UNDER THEIR JURIS-3
DICTION. 4
Not later than January 31, 2025, and annually there-5
after, the Secretary of the Army shall provide to the Com-6
mittees on Armed Services of the Senate and House of 7
Representatives a briefing regarding— 8
(1) how the Secretary has implemented guid-9
ance issued on February 5, 2024, titled ‘‘Account-10
ability and Welfare of Soldiers and DA Civilians’’ 11
that restated and emphasized the policies of the 12
Army regarding the responsibility of commanders to 13
check on the health and welfare of personnel, par-14
ticularly following an injury or significant medical 15
incident; 16
(2) whether such implementation includes a 17
penalty for failure to follow such guidance; and 18
(3) the methods the Secretary uses to ensure 19
that appropriate medical protocols are followed. 20
