SECTION1.ThatSection46-1005A,IdahoCode,be,andthesameishereby6
amendedtoreadasfollows:7
46-1005A.DISASTEREMERGENCYACCOUNT.(1)Thereisherebycreatedand8
establishedinthestatetreasuryaseparateaccounttobeknownasthedis-9
asteremergencyaccount,
whichaccountshallbeadministeredbythegovernor10
orhisdesignee.Theaccountshallonlybeusedtopayobligationsandex-11
pensesincurredbythestateofIdahoduring
arisingoutofadeclaredstate12
ofdisasteremergency.13
(2)Inordertopaysaidobligationsandexpensesincopingwith
arising14
outof
adeclaredstateofdisasteremergencythegovernorshallexpendstate15
moneyasfollows:16
(a)Thegovernorshalluseanymoneysavailableinthedisasteremer-17
gencyaccount.18
(b)Intheeventthedisasteremergencyaccountisinadequateto19
satisfysaidobligationsandexpenses,thegovernorisempoweredtodi-20
rect,byexecutiveorder,thestatecontrollertotransfermoneysfrom21
thegeneralaccount
fund,createdpursuanttosection67-1205,Idaho22
Code,tothedisasteremergencyaccount,providedthatinthegover-23
nor'sjudgmentsufficientgeneralaccount
fundmoneyswillbeavailable24
tosupportthefullgeneralaccount
fundappropriationsforthecurrent25
fiscalyear.26
(c)Inadditiontoanypurposeforwhichtheyhavepreviouslybeencre-27
ated,allfunds,
excludingconstitutionallycreatedfunds,orfunds28
limitedintheirapplicationbytheconstitutionofthestateofIdaho,29
areherebyexpresslydeclaredtobeappropriatedforthepurposeof30
effectuatingthepurposesofthisact.Ifthemoneysmadeavailablein31
paragraphs(a)and(b)above
ofthissubsectionareinadequatetomeet32
theabovementioned
suchobligationsandexpenses,thegovernorisem-33
poweredtodirectthestatecontroller,byexecutiveorder,totransfer34
tothedisasteremergencyaccountmoneysfromanyeligibleaccountin35
ordertopaysaidobligationsandexpenses;provided,thatinthegover-36
nor'sjudgment,themoneystransferredarenotrequiredtosupportthe37
currentyear'sappropriationoftheaffectedaccounts.38
(d)Intheeventthatrestitutionismadetothestatefromnonstate39
sourcestoreimbursethestateforcostsincurredinrespondingtoa40
stateofdisasteremergency,thegovernormayusefundsfromtheresti-41

tutiontoreimburseaccountsfromwhichfundsweredrawntopayforthe1
state'sresponsetotheemergency.2
(3)Inadditiontoanyotherpurposeforwhichtheymighthavebeenap-3
propriated,allmoneysmadeavailablebythisacttobeusedintheeventof4
adisasteremergencyareherebyperpetuallyappropriatedforthepurposeset5
forthinthissectionaccordingtothelimitationsestablishedbythissec-6
tionandtheconstitutionofthestateofIdaho.Innoeventmaytherevenues7
madeavailablebysub
section46-1005A(2)(b)and(c),IdahoCode,ofthis8
section
foranyandallemergencypurposesexceed,duringanyfiscalyear,9
onepercent(1%)oftheannualappropriationofgeneralaccount
fundmoneys10
forthatfiscalyearunlessthelegislature,byconcurrentresolution,ap

provesanexceedance,andthegovernormustabidebythetermsofsuchcon

currentresolution

Theprovisionsofthissectionareherebydeclaredtobeseverable.14
Ifanyprovisionofthissectionortheapplicationofsuchprovisiontoany

personorcircumstanceisdeclaredinvalidforanyreason,suchdeclaration

shallnotaffectthevalidityoftheremainingportionsofthissection.

SECTION2.Anemergencyexistingtherefor,whichemergencyishereby18
declaredtoexist,thisactshallbeinfullforceandeffectonandafterits19
passageandapproval.20
