a.“Battery-containingproduct”meansaproduct10
thatcontainsorispackagedwithacoveredbattery.11
“Battery-containingproduct”doesnotincludecomputers,12
small-scaleservers,computermonitors,electronickeyboards13
andmice,printers,faxmachines,scanners,televisions,14
digitalvideodiscplayersandrecorders,videocassette15
recorders,digitalconverterboxes,cablereceivers,satellite16
receivers,portabledigitalmusicplayers,orvideogame17
consoles.18
b.“Batterystewardshiporganization”meansaproducer19
thatdirectlyimplementsaplanapprovedbythedepartment20
underthissectionoranonprofitorganizationdesignatedbya21
producerorgroupofproducerstoimplementsuchaplan.22
c.“Collectionrate”meansthepercentagecalculatedby23
dividingthetotalweightofcoveredbatteriescollectedinthe24
statebyabatterystewardshiporganizationinacalendaryear25
bytheaverageannualweightofcoveredbatteriesestimatedto26
havebeensoldinthestatebyallproducersduringthatsame27
calendaryearandtheprevioustwocalendaryears.28
d.“Collectionsite”meansadesignatedlocationthat29
isapprovedunderabatterystewardshipplanwhereportable30
batteriesormediumformatbatteriesmaybedroppedoffby31
membersofthepublic.Collectionsitesshallbeoperated32
inaccordancewiththeapplicablerequirementsofabattery33
stewardshiporganization’sapprovedbatterystewardshipplan.34
However,collectionsitesareindependentofthebattery35

U.S.C.§301etseq.,andthatisnotdesignedormarketedfor7
saleorresaleatretaillocationsforpersonaluse.8
(2)Abatterythatcontainsanelectrolyteasafreeliquid9
oraproductthatcontainssuchabattery.10
(3)Aleadacidbatteryoraproductthatcontainssucha11
battery.12
(4)Abatterythatisacomponentofamotorvehicleorthat13
isintendedforuseexclusivelyinmotorvehicles.14
(5)Abatteryinaproductthatisnotintendedordesigned15
tobeeasilyremovedbytheuserwithnomorethancommonly16
usedhouseholdtools.17
f.“Mediumformatbattery”meansanyofthefollowing:18
(1)Forbatteriesthatarenotcapableofbeingrecharged,19
abatterythatweighsmorethanfourandfour-tenthspoundsbut20
notmorethantwenty-fivepounds.21
(2)Forrechargeablebatteries,abatterythatweighsmore22
thanelevenpounds,orthathasaratingofmorethanthree23
hundredwatt-hours,orboth,butthatdoesnotweighmorethan24
twenty-fivepoundsorhavearatingofmorethantwothousand25
watt-hours.26
g.“Plan”meansthebatterystewardshipplan.27
h.“Portablebattery”meansanyofthefollowing:28
(1)Forbatteriesthatarenotcapableofbeingrecharged,a29
batterythatweighsnomorethanfourandfour-tenthspounds.30
(2)Forrechargeablebatteries,abatterythatweighsno31
morethanelevenpoundsandthathasaratingofnomorethan32
threehundredwatt-hours.33
i.“Primarybattery”meansabatterythatisnotcapableof34

forsale,ordistributesforsaleacoveredbatteryor2
battery-containingproductinorintothestateinaccordance3

(a)Ifthecoveredbatteryorbattery-containingproductis5
soldunderabrandofthebattery’sorproduct’smanufacturer,6
thepersonthatmanufacturesthebatteryorproduct.7
(b)Ifthecoveredbatteryorbattery-containingproductis8
soldunderaretailbrandorunderabrandownedbyaperson9
otherthanthebattery’sorproduct’smanufacturer,theperson10
thatownsthebrand.11
(c)Ifsubparagraphdivisions(a)and(b)donotapply,12
thepersonthatisthelicenseeofabrandortrademarkunder13
whichthecoveredbatteryorbattery-containingproductis14
sold,offeredforsale,ordistributedforsaleinorintothis15
state,regardlessofwhetherthetrademarkisregisteredin16
thisstate.17
(d)Ifsubparagraphdivisions(a)through(c)donot18
applytoanypersonwithintheUnitedStates,theperson19
thatistheimporterofrecordforthecoveredbatteryor20
battery-containingproductintotheUnitedStatesforthe21
purposeofselling,offeringforsale,ordistributingforsale22
thebatteryorproductinorintothisstate.23
(e)Ifsubparagraphdivisions(a)through(d)donotapply24
toanypersonwithacommercialpresenceinthisstate,the25
personwhofirstsells,offersforsale,ordistributesfor26
salethecoveredbatteryorbattery-containingproductinor27
intothisstate.
